August 26, 2025 – Sauder Schelkopf, along with co-counsel, has filed a class action lawsuit in the U.S. District Court for the Northern District of California on behalf of California homeowners against Uponor, Inc. The complaint alleges that Uponor’s Red, White, and Blue AquaPEX piping systems (“Uponor PEX”) are defective and prone to premature failure, causing leaks and significant property damage.

The lawsuit seeks damages and injunctive relief for affected homeowners whose homes contain Uponor PEX piping manufactured and sold between 2010 and 2021. According to the complaint, homeowners across California have reported repeated leaks, cracks, and water damage linked to oxidative degradation and alleged manufacturing flaws in the plastic piping.

Allegations in the Complaint

The complaint alleges that:

  • Uponor PEX pipes suffer from a defect that causes premature oxidation, embrittlement, and cracking well before the company’s claimed lifespan.
  • Homeowners have incurred substantial costs for repairs, remediation, and full repiping of their homes after repeated leaks.
  • Uponor allegedly knew of the defects for years but failed to disclose them to consumers, contractors, or building officials.

The lawsuit asserts claims under California consumer protection laws, negligence, fraud by concealment, strict liability, and unjust enrichment. Plaintiffs seek compensation for repair costs, property damage, and other relief available under the law.

Potential Impact on Homeowners

According to the complaint, thousands of California homes may have been built with the affected Uponor PEX piping, which was marketed for use in potable water distribution, radiant heating, and fire protection systems. The alleged defects may result in ongoing leaks and water damage if the pipes are not replaced.
