Sauder Schelkopf is investigating potential class action lawsuits on behalf of patients at the Nashville-based the Vanderbilt Clinic, who is “notifying patients that they may have been exposed to hepatitis B, hepatitis C and HIV as a result of endoscopy procedures performed at a clinic located on the hospital’s main campus.”

The risk to patients is low, a spokesperson for Vanderbilt said. However, anyone potentially infected is being notified as a precaution. Around 4% of total procedures are linked to potential exposure to viruses. A solution used during the procedure is being blamed for the risk of infection, but the state health department is still investigating the incidents.
“We recently discovered an issue in how a solution was administered through the scope during a limited number of endoscopy procedures at the Vanderbilt Clinic. We immediately corrected the issue and reported it to the Tennessee Department of Health. We are in the process of notifying patients who had an endoscopy procedure and may have been affected,” a Vanderbilt spokesperson said in a statement.

Sauder Schelkopf filed a class action lawsuit on behalf of patients in Oregon who may have been exposed to infectious diseases. It has been reported that approximately 2,400 patients may have been exposed to Hepatitis B and C as well as HIV as a result of a physician allegedly not following safety practices during medical procedures.

Sauder Schelkopf is also co-counsel in a class action lawsuit against MultiCare Good Samaritan Hospital in Puyallup, Washington for allegations that an emergency room nurse infected with Hepatitis C was injecting herself with a partial dose of narcotics intended for her patients and then injecting the remaining dose with the same needle into her patients. Approximately 2,600 emergency room patients who received injections of narcotics, antihistamines or sedatives while the nurse was on duty between August 4, 2017, and March 23, 2018 are being notified by the hospital to be tested.
