Our law firm is investigation allegations that Shellpoint and its predecessor (Specialized Loan Servicing, LLC) unlawfully inflated mortgage balances, failed to provide legally required monthly mortgage statements, and wrongfully pursued collection and foreclosure efforts years after the original debts were discharged in bankruptcy.

Key Allegations:
  • Failure to Provide Monthly Statements: It is alleged that periodic billing statements were not sent to borrowers whose second mortgages were discharged in bankruptcy, violating certain laws including the Truth in Lending Act (TILA).
  • Illegal Fees and Interest: It is further alleged that Shellpoint retroactively assessed interest and fees during periods when no statements were sent, inflating borrowers’ balances.
  • Foreclosure Threats: Borrowers were allegedly blindsided by foreclosure notices for inflated balances, some exceeding $200,000.
Who May Be Impacted?
  1. Borrowers who held second mortgages serviced by Specialized Loan Servicing (now Shellpoint).
  2. Received a bankruptcy discharge for their second mortgages.
  3. Were not provided monthly statements but were later pursued for payment or foreclosure.
Contact us if you:
