A federal court in North Carolina granted final approval to a $1.5 million WARN Act settlement on behalf of over 300 former North State Aviation employees. The final approval comes over a year after North State abruptly terminated business operations without notice. North State Aviation, located in Winston-Salem, was an aviation maintenance business. The federal Worker Adjustment and Retraining Notification Act (WARN Act) requires employers contemplating mass layoffs to give its employees at least 60 days’ notice or pay its employees backpay for the 60 days. In approving the settlement, the court described the result as “excellent” and recognized it took “skilled counsel to successfully manage” a case where over 300 class members lost their jobs and were in regular contact with Sauder Schelkopf throughout the litigation.
