Sauder Schelkopf is investigating Uponor PEX plumbing failures. PEX (cross-linked polyethylene) is a type of plastic tubing that is used in both plumbing and heating applications. PEX has been installed in the United States over the last 10 to 15 years. Because of its ease of installation, reliability, and relatively low cost, PEX is continuously growing in popularity. PEX, however, has its downside. Extreme bends and kinks may place high local stress on the wall of the pipe making it susceptible oxidative degradation. Some PEX manufacturers may use processes that are not uniform in composition. Some PEX may quickly degrade and become brittle when exposed to hot chlorinated water.

Experience Matters

Sauder Schelkopf has a nationally recognized consumer class action practice with significant experience representing millions of individuals throughout the country. We, along with co-counsel, secured a $43.5 million nationwide class action settlement related to plumbing products manufactured by NIBCO.  Sauder Schelkopf served as court appointed co-lead counsel in the lawsuit, which was filed in December 2013 and involved NIBCO’s PEX tubing, fittings, and clamps. It was alleged that the PEX products are prone to failure, leading to water damage.  “This case was fiercely contested for over five years. The proposed settlement is an excellent result for homeowners.  It provides substantial relief for past and future failures of NIBCO’s PEX products, including the option for a replumb,” said Joe Sauder of Sauder Schelkopf.  This was one of the Top 10 settlements in New Jersey in 2018. The attorneys at Sauder Schelkopf have recovered hundreds of millions of dollars on behalf of consumers who purchased faulty products. We recently served as co-lead counsel in a $14 million settlement in Nebraska related to defective water connectors. We also recently settled a national class action in Washington state on behalf of tens of thousands of homeowners who had defective water filter systems installed under their sinks. Additionally, we recently achieved a $16.5 million settlement regarding defective toilet connectors.
