PHILADELPHIA, PA – Sauder Schelkopf, a nationally recognized law firm specializing in complex consumer class actions, announced today that the U.S. District Court for the Northern District of Georgia has denied Delta Air Lines’ motion to dismiss the central claims in a class action lawsuit arising from the airline’s prolonged operational breakdown following the July 2024 CrowdStrike software outage.
The ruling permits the case to proceed on behalf of passengers denied refunds and reimbursements after thousands of flight cancellations and delays disrupted travel across the United States and abroad.

The complaint alleges that Delta failed to adequately respond to the global CrowdStrike IT failure on July 19, 2024, leaving Delta’s systems down longer than those of any major competitor. Plaintiffs claim the airline’s outdated infrastructure, refusal to accept real-time assistance from CrowdStrike, and noncompliance with U.S. Department of Transportation refund rules caused severe passenger harm.
