Sauder Schelkopf and Caffery Clobes Meriwether & Sprengel filed a lawsuit on behalf of individuals who purchased tickets for the Ultra Music Festival that was scheduled for March 20-22, 2020 in Miami, Florida. On Nov. 23, 2020, the Court issued an Order partially granting Ultra’s Motion to Compel Arbitration and staying the case pending the arbitration.
The lawsuit (No. 20-22495) that was pending in the Southern District of Florida was dismissed by the Court on August 31, 2021:
(a) The individual claims asserted by our clients, plaintiffs Samuel Hernandez and Richard Montoure, against Defendant have been dismissed with prejudice, (b) the putative class claims have been dismissed without prejudice, and (c) if any individuals wish to proceed with claims against Defendant, they should be aware that their claims are subject to a statute of limitations and failure to file within the statute of limitations may bar the claim.
