Sauder Schelkopf LLC is investigating a potential class action lawsuit against Sealy, the North Carolina-based bedding manufacturer, following widespread reports in March 2023 that many popular, everyday baby products contain dangerous “forever chemicals” that are scientifically proven to cause cancer and other serious health conditions.

Hundreds of everyday products are made with highly toxic fluorinated chemicals called PFAS (per-and polyfluoroalkyl substances), PFOA (Perfluorooctanoic acid), and/or PFOS (perfluorooctane sulfonate). These chemicals are commonly referred to as “forever chemicals.” Examples of everyday products that contain harmful forever chemicals are: nonstick cookware, paper and cardboard products used to wrap or contain fast food, baked goods, etc., stain-resistance furniture and carpets, clothing labeled as stain or water-repellent, and even cosmetics and personal care products such as makeup, sunscreen, shampoo, and shaving cream.

Through the widespread sale and use of these everyday items over the course of the past 2-4 decades, the harmful forever chemicals contained in them have made their way into ground and drinking water. For instance, the Environmental Working Group reported that nearly all Americans, including newborn babies, have PFAS in their blood, and more than 200 million people may be drinking PFAS-tainted water.

Numerous studies link forever chemicals to the following serious health complications:

• Testicular, kidney, liver and pancreatic cancer.
• Reproductive problems
• Weakened childhood immunity
• Low birth weight
• Endocrine disruption
• Increased cholesterol
• Weight gain in children and dieting adults
