Sauder Schelkopf is investigating a class action against various companies that gather individuals’ names, voices, signatures, photographs, images, likeness, or distinctive appearances for commercial purposes without prior written consent. Many states have laws prohibiting the use of that information without prior written consent.
Sauder Schelkopf represented children ages 14-17 years old who used TikTok in a class action settlement alleging that the social media platform collected and stored users’ biometric data without their consent, violating an Illinois biometric privacy law. On July 28, 2022, a federal judge granted final approval to the $92 million class action settlement against TikTok and parent company ByteDance for the company’s alleged violation of users’ private data.
