Sauder Schelkopf filed a class action lawsuit against Capital Jazz Productions, a company that specializes in among other things organizing music-themed cruise ship charters. It is alleged that in January 2021, Capital Jazz chartered the M/V Independence of the Seas from Royal Caribbean for an 8-night jazz-themed chartered voyage called SuperCruise XIV. SuperCruise XIV was scheduled to set sail on January 14, 2022, from Port Canaveral, Florida, but reportedly on January 7, 2022, Capital Jazz emailed passengers who had booked the cruise, to inform them that it had canceled SuperCruise XIV.

Reportedly, a few weeks later, on January 24, 2022, Capital Jazz emailed passengers who had booked the cruise to offer them two options: (1) deferring the cruise until January 2023, or (2) a full refund. Passengers who selected a full refund have reportedly complained that they still have not received a refund of their money, some of whom paid over $5,000 for SuperCruise XIV.

“Our clients paid thousands of dollars for a January 2022 cruise that never set sail. They should have never had to file this lawsuit but they have yet to receive their promised cash refund,” said Joe Sauder of Sauder Schelkopf.

Sauder Schelkopf served as court-appointed Class Counsel in a class action settlement on behalf of purchasers of credentials for the 2020 South by South West Conference & Festivals in Austin, Texas that was canceled due to COVID-19. The court granted final approval to the settlement on February 18, 2022.
