Background

In February 2026, the United States Supreme Court held that the International Emergency Economic Powers Act (IEEPA) does not authorize the President to impose tariffs. As a result, tariffs imposed beginning in February 2025 under a series of Executive Orders were declared unlawful.

A complaint filed in the United States Court of International Trade by Nissan North America confirms that substantial tariffs were imposed starting in February 2025 and continued until they were invalidated by the Supreme Court in February 2026.

These tariffs affected imported goods, including automotive products and components.

Why This Matters to Consumers

During 2025 and into 2026, some vehicle manufacturers and dealerships disclosed line-item charges described as:

  • “Tariff Adjustment”

  • “Import Tariff”

  • “Government Surcharge”

  • “Trade Adjustment Fee”

  • Or similar tariff-related charges

If these tariffs were unlawfully imposed and later invalidated, consumers who directly paid itemized tariff charges as part of their vehicle purchase may be entitled to reimbursement.

We are seeking to speak with:

  • Individuals who purchased or leased a Nissan vehicle in 2025 or 2026;

  • Whose purchase agreement, buyer’s order, or invoice reflects an itemized tariff or import-related surcharge;

  • And who paid that amount as part of the transaction.

What We Are Investigating

Our investigation is focused on whether:

  • Consumers were charged tariff amounts that were later deemed unlawful;

  • Those charges were passed through directly to buyers; and

  • Consumers may be entitled to recover those funds.
