October 7, 2025 — A federal judge may now decide whether to dismiss a class action lawsuit filed on behalf of California bar exam test takers whose February 2025 exam was disrupted by widespread technical failures.
Defendant ProctorU, operating as Meazure Learning, has asked the U.S. District Court for the Northern District of California to throw out the case, arguing that its one-time-use testing software is an “intangible item” not covered by California’s consumer protection laws. The company also contends that no contract existed between it and the test takers, since fees were paid to the State Bar of California.
The February 2025 exam marked California’s first attempt at a hybrid in-person and remote format, a move intended to save nearly $4 million annually. Instead, examinees encountered serious technical problems: login failures, system crashes, frozen screens, broken copy-and-paste functions, and disruptive proctoring. Some students were unable to access the exam at all.
Three lawsuits were filed following the exam and consolidated in June 2025. Plaintiffs allege that Meazure Learning failed to properly administer the exam, violating state consumer protection laws and causing severe stress, emotional harm, and financial losses.
In their complaint, the plaintiffs assert that “rather than carefully designing and releasing a functioning platform, Meazure rushed to deploy a platform that was not ready to accommodate the foreseeable number of test takers.”
Attorneys for the plaintiffs Joseph Sauder of Sauder Schelkopf LLC and Katherine Aizpuru of Tycko & Zavareei LLP issued a joint statement responding to the dismissal motion:
“Meazure’s motion is yet another attempt to avoid accountability. Our clients allege that the company’s exam platform failed during one of the most important professional tests of their lives, leaving them with frozen screens, error messages, and lost work. This case is about ensuring accountability and protecting the integrity of the bar exam process. We look forward to presenting these claims in court.”
Separately, Meazure is also facing a lawsuit filed by the State Bar of California, which entered into a $4.1 million contract with the company in September 2024 to administer the exam.
