September 5, 2025 – Sauder Schelkopf together with Levin Sedran & Berman, has filed a class action lawsuit in the Court of Common Pleas of Luzerne County, Pennsylvania, on behalf of property owners who purchased undeveloped lots at the Eagle Rock Resort in Hazleton, Pennsylvania.

The lawsuit alleges that Eagle Rock Resort Co., LLC, Eagle Rock Real Estate Co., United Equitable Mortgage Corporation, and Double Diamond – Delaware, Inc. engaged in a long-running scheme that misled consumers into purchasing undeveloped lots at inflated prices.

According to the complaint, Eagle Rock developers and affiliated entities marketed the resort’s undeveloped lots as investment properties, promising that property values would rise through the development of community amenities such as golf courses, ski facilities, and an aquatic center. In practice, many purchasers were left with properties worth only a fraction of their purchase price—often between $5,000 and $8,000—compared to sales prices ranging from $30,000 to $100,000.

“These families were told they were making a sound investment in a growing resort community, when in reality they were left with grossly overpriced parcels of vacant land,” said Joe Sauder, partner at Sauder Schelkopf. “Through this case, we seek to hold the Eagle Rock defendants accountable and to recover damages for those who we allege were misled.”

This filing follows a related enforcement action initiated in January 2025 by Pennsylvania Attorney General against Eagle Rock Resort developers, which alleged deceptive practices in the marketing and sale of undeveloped lots.
