April 11, 2025 – Philadelphia, PA – The Honorable Karen Spencer Marston of the United States District Court for the Eastern District of Pennsylvania has granted final approval to a class action settlement resolving claims on behalf of homebuyers at the Greystone subdivision in West Chester, Pennsylvania.
The lawsuit related to a special assessment tied to the Greystone development. As set forth in the briefing, Plaintiffs alleged that Defendant NVR, Inc. failed to disclose that the Special Assessment was subject to interest and administrative fees if not paid off in full at the time the homeowners closed on their property. NVR maintained that nothing on the disclosure is false or misleading and purchasers were provided information to make an informed decision when purchasing within the NID.
Under the terms of the settlement, class members will receive cash payments based on a formula reflecting the amounts paid—or expected to be paid—in interest and fees on the special assessment. The settlement provides targeted relief ranging from approximately $1,200 to $12,800 per homeowner.
The Court also approved service awards for the representative plaintiffs and granted Sauder Schelkopf’s motion for attorneys’ fees, recognizing the firm’s diligent work over the past three years, including extensive investigation, motion practice, discovery, and complex settlement negotiations.
