Sauder Schelkopf filed a class action lawsuit on behalf of individuals who purchased COVID testing kits that were subsequently recalled.

Bloomberg reported, in part, on Nov. 10, 2021:

Ellume Ltd. is recalling 2.2 million at-home Covid-19 tests because they risk returning false positives, the U.S. Food and Drug Administration said.

The regulator classified the action on Wednesday as a class I recall, the most serious kind, saying it has received 35 reports of false positives from the test made by the Australian company. Incorrect results could lead a person to wrongly receive Covid-19 treatments or isolate when they don’t need to, the FDA said

This follows a smaller recall in October 2021.  USA Today reported, in part, on Oct 5, 2021:

An Australia-based company is recalling hundreds of thousands of coronavirus tests after discovering some Ellume COVID-19 home tests deliver higher-than-anticipated false positive results. 

Ellume became the first company to gain Food and Drug Administration authorization to sell consumers kits at major retailers such as Walmart, CVS, Target and Amazon. The kits don’t require a prescription and deliver results in minutes.
