Sauder Schelkopf is investigating a potential class action lawsuit on behalf of consumers who have been unlawfully charged out-of-network (“OON”) ATM fees. It has been alleged that certain banks are charging fees for ATM services such as balance inquiries, deposits, and withdrawals without providing notice.

The Electronic Fund Transfer Act requires ATM operators to provide “clear and conspicuous”  notice of their fees “on or at the machine.” The notice must be “clear and readily understandable” to consumers.
